These Terms of Service ("Terms") govern your access to and use of the website at breathofestova.com, the Breath of Estova game, and related services (together, the "Services"), operated by Estova Studios ("Breath of Estova", "we", "us", or "our").
By accessing or using the Services, or by purchasing any item through them, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least the age of majority in your jurisdiction, or have the consent of a parent or legal guardian, to use the Services or make purchases. By using the Services you represent that you meet these requirements and that you are not located in, or a resident of, any country or region subject to sanctions or trade restrictions that would prohibit your use of the Services.
To access certain features you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
Gems. Gems are a virtual in-game currency used to obtain digital items and content within Breath of Estova. Gems have no monetary value, cannot be exchanged, redeemed, or cashed out for real-world currency or cryptocurrency, and cannot be transferred or withdrawn from your account. Gems are licensed to you for use within the game only.
Founder Packs and digital items. Founder Packs and other digital items provide in-game content, cosmetics, access, and similar benefits. Except where an item includes an optional on-chain collectible (see Section 4), all items are licensed to you for personal use within the game and are not owned property that can be resold outside the Services.
Payments. Purchases are processed by third-party payment providers. By making a purchase, you agree to the applicable processor's terms in addition to these Terms. You are responsible for any taxes associated with your purchases where applicable.
Pricing and availability. We may change prices, item contents, and availability at any time. Limited items may be capped in quantity, and once sold out may not be offered again.
Certain purchases may include an optional on-chain collectible (such as a Founder Pass or mount) delivered to a blockchain wallet address you provide at checkout. Providing a wallet address is optional. On-chain items are recorded on the Monad blockchain, which is public and immutable. We are not responsible for wallet addresses entered incorrectly, lost private keys, or transactions on the blockchain, which we cannot reverse. Ownership and transfer of on-chain collectibles are subject to the underlying blockchain and any applicable smart contracts.
Because Gems, Founder Packs, and digital items are delivered digitally and consumed within the Services, all purchases are final and non-refundable except where required by applicable law. Where a refund is required by law (for example, statutory withdrawal rights for consumers in certain jurisdictions), we will honor those rights. All virtual items, Gems, and in-game content remain part of the Services and are licensed, not sold, to you. We reserve the right to manage, modify, or remove virtual items and content as part of operating the game. If your account is terminated for violation of these Terms, you may lose access to your account and any associated virtual items without refund. On-chain collectibles already delivered to your own wallet remain in your wallet, subject to the blockchain.
All content in the Services — including artwork, characters, game design, code, logos, and text — is owned by Estova Studios or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial enjoyment. You may not reproduce, distribute, or create derivative works from our content without permission, except as expressly allowed.
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or secure. Blockchain networks and third-party payment providers are outside our control, and we are not responsible for their performance.
To the fullest extent permitted by law, Estova Studios and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or virtual items, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid to us in the twelve months preceding the claim.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
We may modify, suspend, or discontinue any part of the Services at any time. We may also update these Terms from time to time; when we do, we will revise the "Last updated" date. Material changes will be communicated through the Services where appropriate. Your continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any disputes will be subject to the courts of the Netherlands, except where applicable consumer law grants you the right to bring proceedings in your local courts.
